HOMELESS SERVICES | FOSTER CARE | MOCAP  |  RFP’S

Homeless children have the right to a free, appropriate public education.

42 U.S.C. § 11434a(2)

The term “homeless children and youth”—

A.  means individuals who lack a fixed, regular, and adequate nighttime residence…; and
B. includes —

i. children and youths who are sharing the housing of other persons due to loss of housing, economic hardship, or a similar reason; are living in motels, hotels, trailer parks, or camping grounds due to the lack of alternative adequate accommodations; are living in emergency or transitional shelters; or are abandoned in hospitals;
ii. children and youths who have a primary nighttime residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings…;
iii. children and youths who are living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train stations, or similar settings; and
iv. migratory children…who qualify as homeless for the purposes of this subtitle because the children are living in circumstances described in clauses (i) through (iii).

You have the right to:

A.  Immediately enroll in and attend school without having health and school records with you
B.  Enroll in the school where you are living or the school attended when permanently housed, if in your child’s best interest
C.  Receive transportation to and from school of origin to the extent feasible
D.  Participate in school-related activities and receive other needed services
E.  Utilize the dispute resolution process if you have a grievance

The Biome School is committed to ensuring and facilitating the proper educational placement, enrollment in school, and checkout from school for foster children.  To facilitate this process and to serve as the educational liaison for The Biome School’s foster children, The Biome School will designate a staff member to oversee and assess The Biome School’s foster care program.

The Biome School’s educational liaison for foster care children will serve in an advisory capacity to:

  • Ensure and facilitate proper educational placement, enrollment in school, and checkout from school;
  • Assist foster care children when transferring from one school to another or from one school district to another, including, among other things, proper transfer of credit, records, and grades;
  • Request school records within two (2) business days of placement of a foster care child in The Biome School;
  • Submit school records of foster care pupils within three (3) business days of receiving a request for school records from another school or school district; and
  • Facilitate access to student records to any child placing agency for the purpose of fulfilling education case management responsibilities required of the juvenile officer or by law and to assist with the school transfer or placement of a child under foster care.

The Missouri Course Access Program (MOCAP) offers students equal access to various quality courses and educational opportunities. Children attending public schools in Missouri have a right to participate in the Missouri course access and virtual school program as provided in State Law. Because virtual instruction can be an effective educational option, some students take advantage of opportunities through our MOCAP Partner – LAUNCH. Additionally, parents can choose another provider on the MOCAP website.

As required by Missouri statute Section 161.670 (effective August 28, 2022), any student under the age of twenty-one in grades kindergarten through twelve shall be allowed to enroll in Missouri course access and virtual school program courses of his or her choice as part of the student’s annual course load each year or a full-time virtual school option.
